I. General Terms and Conditions
Section 1 Scope and Choice of Law
(1) All contracts you conclude with us (Schachatelier Berlin, owner Özgür Özel) via the website www.schachatelier.de are governed exclusively by German law. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) The United Nations Convention on Contracts for the International Sale of Goods (CISG) expressly does not apply.
(3) The place of performance and jurisdiction for all disputes arising from this contract is, to the extent legally permissible, our place of business in Berlin.
(4) We object to the inclusion of any of the customer's own terms and conditions, unless otherwise agreed.
(5) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A trader is any natural or legal person who, when concluding the contract, acts in the exercise of their trade, business, or profession.
Section 2 Subject Matter and Formation of the Contract
(1) The subject matter of the contract is exclusively the sale of handcrafted chess sets and matching chess accessories. (2) By listing a product on our website, we make a binding offer to conclude a contract on the stated terms. (3) The contract is formed through the online shopping cart system: the desired items are placed in the cart. After entering your personal details and payment and shipping information, you receive a final order summary. By submitting the order via the “order with obligation to pay” button (or similar), you legally bind yourself to accept the offer; the contract is thereby formed. (4) Order processing is largely automated via email. Please ensure that your registered email address is correct and that email receipt is technically ensured (including no blocking by spam filters).
Section 3 Personalized Goods (Engraving)
(1) For products with a name or text engraving, you provide us with the necessary information via the ordering system. Any specifications regarding character count or format must be observed. (2) You undertake not to submit any content that infringes the rights of third parties (in particular copyright, name, or trademark rights) or violates applicable law. You indemnify us against any related third-party claims. (3) We do not review the engraving text you submit for factual accuracy (e.g., spelling) and accept no liability in this regard. (4) Personalized products are excluded from the statutory right of withdrawal once individual production has begun (see Right of Withdrawal).
Section 4 Payment Methods
The available payment methods are shown to you during the ordering process. Payments via Shopify Payments, Klarna, or PayPal are processed through the respective payment service providers; further information can be found in our Privacy Policy.
Section 5 Retention of Title
The goods remain our property until full payment of the purchase price has been received.
Section 6 Warranty
(1) The statutory warranty rights for defects apply. (2) We ask that you inspect the goods upon delivery for completeness, obvious defects, and transport damage, and notify us of any complaints promptly. This does not affect your statutory warranty rights.

3. Contract Language, Storage of Contract Text
The language of the contract is German. We do not separately store the contract text; you will receive the order data as well as these Terms and Conditions by email after the contract is concluded.
4. Essential Characteristics of the Goods
The essential characteristics can be found in the respective product description of the chess set or accessory.
5. Prices and Payment Terms
All stated prices are total prices including statutory value-added tax. Details on shipping costs are shown separately in the respective offer and during the ordering process. For deliveries outside the EU, additional costs (customs duties, taxes) may apply and are to be borne by the customer.
6. Delivery Terms
Delivery terms and times can be found on the dedicated information page in the shop. For consumers, the risk of accidental loss passes only upon handover of the goods to the customer.
